General conditions of operation of the card




PRELIMINARY ARTICLE: SUBSCRIPTION BY COMPANIES

The Abidjan.net VISA Prepaid Card co-branded with NSIA Banque Côte d'Ivoire is strictly reserved for the use of natural persons; companies can not therefore hold them.

However, WEBLOGY OFFSHORE client companies or not, can subscribe to an unlimited number of ABIDJAN.NET prepaid VISA cards on behalf of their staff or agents.

It will be up to any company having subscribed to the Abidjan.net VISA Prepaid Card on behalf of a natural person, to provide all the information relating to this person.

Any change in the use of a Prepaid Abidjan.net VISA Card subscribed by a company must be previously notified, in writing, to WEBLOGY OFFSHORE.

Once individualized, Abidjan.net VISA prepaid cards subscribed by companies are subject to the conditions and rules of the following articles.

ARTICLE 1 : OBJECT OF THE CARD

The Abidjan.net VISA prepaid card of WEBLOGY OFFSHORE is both a payment and withdrawal card, in accordance with the regulation n ° 15/2002 / CM / UEMOA on payment systems in UEMOA Member States. It allows you to do the following:

1.1 Cash withdrawals from NSIA BANK (hereinafter referred to as the "Partner Bank") cash dispensers (ATM / ATM) exclusively, and from VISA International banking institutions (which display the acronym VISA) and / or GIM-UEMOA (displaying the acronym GIM-UEMOA) subject to a fee per transaction.

1.2 Regulations for the purchase of goods or services from merchants and service providers displaying their membership of the international VISA network and / or the GIM-UEMOA sub-regional network.

1.3 These withdrawals are possible within a limit set by the bank and notified to the holder. The cap may be different depending on whether the withdrawals are made:

  • On the distributors of NSIA BANK
  • Distributors and authorized counters in both Côte d'Ivoire and abroad.

In some cases, they may be subject to transaction pricing.

ARTICLE 2 : ISSUE OF THE CARD

2.1 Cards are issued to known third parties (persons in account with the bank) or unknown (persons without an account in the bank) subject to acceptance of the request by the Bank.

2.2 Individuals may only subscribe to two (2) cards at most.

2.3 No one may hold more than two cards at a time.

2.4 The card is strictly personal, its holder must necessarily affix his signature upon receipt. The lack of signature on the card justifies the refusal of acceptance of this card by merchants. However, it is the property of WEBLOGY OFFSHORE, which reserves the right to withdraw it at any time. It is strictly forbidden for the cardholder to lend or dispose of it.

Its use is strictly limited :

  • Withdrawing cash from ATMs / ATMs
  • To give a payment order to settle the purchase of goods actually delivered and services actually rendered.

ARTICLE 3 : FINANCIAL CONDITION

The card is issued for the payment of the sum of 9,500 CFA francs in the points of sale abidjan.net

ARTICLE 4 : CONFIDENTIAL CODE

It is given a 4-digit PIN code to the cardholder. This code is requested for the use of the card on ATMs, ATMs and TPEs

A password is also communicated to the cardholder to enable him to access his electronic account on the site carte.abidjan.net

This password can be changed at any time by the cardholder. A verification code of three (03) digits is written on the back of the card. It aims to secure its transactions on the internet.

The card holder must keep his / her codes and password secret.

He must not write them on the map or on any document. He must compose them away from prying eyes.

The PIN code is indispensable in the use of ATMs and TPEs designed so that no operation can be performed without implementation of this means of access. The number of successive attempts to dial the PIN code is limited to three (03) on the automatic devices, with the risk of confiscation or invalidation of the card at the third unsuccessful trial.

ARTICLE 5 : ADMISSIBILITY OF OPPOSITIONS

The payment order given by means of the card is irrevocable.
Only receivables expressly motivated by the loss or theft of the card, the fraudulent use of the card or data related to its use, the recovery or the judicial liquidation of the beneficiary of the payment are admissible by WEBLOGY OFFSHORE.

ARTICLE 6 : MODALITY OF OPPOSITIONS

6.1 The cardholder must declare the loss or theft of the card as soon as possible. This declaration must be made to WEBLOGY OFFSHORE during its opening hours by telephone or declaration delivered on the spot.

6.2 Any objection that has not been the subject of a signed declaration must be confirmed within 24 business hours to WEBLOGY OFFSHORE holding the account on which the card is operated.
In case of dispute on the opposition, it will be deemed to have been made on the date of receipt of said letter by WEBLOGY OFFSHORE.

6.3 WEBLOGY OFFSHORE can not be held responsible for the consequences of a telephone opposition which does not emanate from the holder of the.

6.4 In case of theft or fraudulent use of the card or data related to its use, WEBLOGY OFFSHORE may request a receipt or a copy of the complaint.

ARTICLE 7 : RESPONSIBILITY OF THE CARD HOLDER

7.1 Principles

The cardholder is responsible for the use and preservation of the card, in strict accordance with the provisions of article 2 above. He assumes the consequences of the use of the card and the confidential codes as long as he has not opposed in the conditions provided for in articles 5 and 6.

7.2 Transactions made before opposition

They are the responsibility of the holder, regardless of any fault or imprudence on his part. However, in certain circumstances it may be possible to limit the cash withdrawals and / or payments for the period concerned.

7.3 Operations after opposition

They are the responsibility of WEBLOGY OFFSHORE with the exception of operations performed by the card holder. Opposition fees may be charged by the Bank

ARTICLE 8 : SPECIFIC PROVISIONS FOR AUTOMATIC APPLIANCES

The recordings of the automatic devices or their reproduction on an automatic support constitute the proof of the operations carried out by means of the card and the justification of their imputation to the account on which this card functions.

ARTICLE 9 : USE OF THE CARD FOR THE PURCHASE OF GOODS OR SERVICES

9.1 The Abidjan.net VISA Prepaid Card must not be used for illegal motive, including for the purchase of goods and services prohibited by the applicable local legislation in the bearer's jurisdiction.

9.2 The payment order given by means of a payment card is irrevocable. The card is a means of payment that should only be used to pay for purchases of goods and services actually made.

9.3 Payments by this card are made according to the conditions and procedures in force at the participating merchants. These procedures involve signing the invoice or ticket issued by the merchant by the cardholder. The verification of the conformity of this signature with the specimen deposited on the card is the responsibility of the merchant.

9.4 The payments presented to the cashing by the merchants are automatically debited to the account of operation of the card concerned, according to the arrangements agreed between the holder of this one and WEBLOGY OFFSHORE.

9.5 WEBLOGY OFFSHORE remains foreign to any dispute that may arise between the cardholder and the merchant. The existence of a dispute can not in any way justify the refusal of the cardholder to honor the card payments.

9.6 Payment to the merchant is refused :

  • When the card is on the list of opposition cards
  • After three incorrect attempts to compose the secret code by the holder
  • If the periodic availability cap is exceeded.

ARTICLE 10 : USE OF THE CARD FOR WITHDRAWALS FROM AUTOMATIC TICKET DISTRIBUTORS

10.1 The card is used for cash withdrawals from ATMs up to a limit set by WEBLOGY OFFSHORE.

10.2 Amounts recorded by automatic cash dispensing machines shall be debited immediately from the account concerned without any obligation to indicate the number or the cardholder used on the statements of account.

10.3 Any card that is out of date or whose use proves to be abnormal is kept by the device. Similarly to ensure the protection of the holder against any fraudulent use by a third party, it is not returned by the device after the third inaccurate composition of the personal code number.

10.4 WEBLOGY OFFSHORE reserves the right to modify at any time the operations accessible on the vending machines and in particular the amounts of sums that may be withdrawn on these devices.

ARTICLE 11 : DURATION OF VALIDITY OF THE CARD - RENEWAL - WITHDRAWAL

The Abidjan.net VISA Prepaid Card has a validity period of 3 years from the date of issue. It is renewable at the end of the term, at the request of the holder by paying the cost of the card.

WEBLOGY OFFSHORE will issue a new card in the event of loss or theft without any modification of the terms of this contract.

WEBLOGY OFFSHORE may, at any time, remove the card or suspend the right to use the card without prior notice, in case of misuse or fraudulent card.

The withdrawal decision is notified in all cases to the cardholder. The holder of the card is obliged, therefore, to return it at the first request of WEBLOGY OFFSHORE. It engages its responsibility, if after notification of the withdrawal of the card by simple letter, it continues to make use of it.

The Cardholder may terminate this Agreement at any time. Its decision must be notified to WEBLOGY OFFSHORE by letter to the bearer against discharge. He undertakes to return the card in case of cancellation.

The holder can ask WEBLOGY OFFSHORE to refund the balance available in case of termination of this contract.

ARTICLE 12 : RETENTION OF DOCUMENTS RELATING TO CARD OPERATIONS - CLAIM TIME

In the event of a claim by the cardholder, both parties agree to provide the best care for their reciprocal information on the conditions of execution of the transaction. The information or documents or their reproductions that WEBLOGY OFFSHORE holds and which relate to the transactions covered by this contract will be kept for ten (10) years by WEBLOGY OFFSHORE. No claim from the cardholder is admissible beyond 70 days after the date of completion of the transaction in question.

ARTICLE 13 : COMMUNICATION OF INFORMATION TO THIRD PARTIES

WEBLOGY OFFSHORE reserves the right to communicate to the authorized authorities, the information concerning the holder of the card in the event of misuse or fraudulent use thereof.

The cardholder authorizes WEBLOGY OFFSHORE to broadcast or have distributed to merchants, financial institutions, organizations interested in the operation of the card, the mentions appearing on his card as well as his address in order to allow in particular the recovery of this card if it was lost, stolen or misused.

ARTICLE 14 : SANCTIONS

Any misuse or fraudulent use of the card and any misrepresentation is punishable by law.

Any misrepresentation or misuse of the card may also result in the loss of the benefit of the contractual provisions.

Any transaction resulting in an operating incident of the account and requiring special treatment will be the subject of the lump sum payable by the account holder.

All costs and expenses of forced recovery of operations are the responsibility of the cardholder. For any dispute that arises between the cardholder and WEBLOGY OFFSHORE, the courts in whose jurisdiction WEBLOGY OFFSHORE is located holding the account on which the card operates are express agreement only competent.

ARTICLE 15 : MODIFICATIONS

WEBLOGY OFFSHORE reserves the right to make changes to the terms of the contract that will be brought to the attention of the cardholder. The operating conditions communicated to the cardholder, accepted by him at the time of the renewal of the card, will be immediately applicable.
